End User License Agreement (EULA)

This End User License Agreement ("Agreement" or "EULA") is a legal agreement between you ("User," "you," or "player") and the developers and operators of Forgotten Lands Online ("we," "us," or "our") concerning your use of the Forgotten Lands Online video game (the "Game") and associated services, including the official website located at: https://forgottenlands.online/ (the "Website").

By creating an account, downloading, installing, or playing the Game, or by accessing your Game account through the Website, you agree to be bound by this Agreement. If you do not agree, do not use the Game or Website.

1. Grant of License

We grant you a personal, non-exclusive, non-transferable, revocable, limited license to download, install, and use the Game solely for personal entertainment purposes, subject to your compliance with this Agreement.

You may not sublicense, rent, sell, lease, modify, distribute, or create derivative works based on the Game or any part thereof unless expressly authorized by us.

2. User Eligibility and Account

To access the Game, you must create an account through the Game client. A valid username, password, and email address are required. These credentials also allow access to the Website for features like viewing rankings and managing account data.

You are solely responsible for maintaining the confidentiality of your login information and all activity conducted under your account.

You must be at least 13 years old or the legal age of digital consent in your country to use the Game.

3. Player-Created Content

As part of gameplay, you may create or submit certain content, including but not limited to player names and custom guild names ("User-Generated Content").

You agree that:

• All User-Generated Content must comply with the Game Rules (see: forgottenlands.online/game-rules/).
• Offensive, vulgar, hateful, discriminatory, sexually explicit, or otherwise inappropriate content is strictly prohibited.
• You do not own any in-game names, guild names, or similar identifiers.
• We reserve the right to edit, remove, rename, or restrict any User-Generated Content at our sole discretion and without notice.
• Repeated or extreme violations may lead to account suspension or permanent ban.

4. Game Rules and Community Standards

All users must follow the Game Rules (available at: forgottenlands.online/game-rules/), which are incorporated into this Agreement by reference.

Violations may result in warnings, account suspension, or permanent account termination, at our sole discretion.

5. Connection Requirements and VPN Restrictions

The Game requires a stable, active internet connection to function. It uses the User Datagram Protocol (UDP), which may be incompatible with VPN services.

We reserve the right to block or restrict access to the Game through VPNs, proxies, or firewalls that interfere with network performance or integrity.

6. Prohibited Conduct

You agree not to:

• Cheat, exploit, or use unauthorized third-party tools or bots.
• Reverse-engineer or decompile the Game or Website.
• Harass, abuse, or threaten other users or staff.
• Attempt to gain unauthorized access to accounts or servers.
• Use misleading names or impersonate other players/staff.
• Interfere with normal gameplay, events, or server operation.

7. Ownership and Intellectual Property

All rights, title, and interest in and to the Game, Website, trademarks, designs, code, and all associated content are the exclusive property of the developers of Forgotten Lands Online.

Nothing in this Agreement grants you ownership of any part of the Game or Website.

The Game is developed using the Intersect Game Engine, which is composed of multiple open-source components with varying licenses. The components distributed to players, including the game client, are licensed under the MIT License. Server-side and development tools such as the Intersect Server and Editor are licensed under the GNU General Public License v3 (GPL v3) but are not distributed to players or made publicly available.

We do not claim ownership over the Intersect Game Engine or any of its original source code. All rights to the Intersect Game Engine and its components remain with their respective authors. 8. Account Suspension and Termination

We may suspend or terminate your account at any time and for any reason, especially for violations of this EULA or the Game Rules.

Termination may be immediate and without prior warning.

9. No Fees or Charges

Forgotten Lands Online is free to play. No payment is required to access the core Game or its features. Optional cosmetic or supporter features (such as the Webshop) may be available, but are not mandatory.

10. Disclaimer of Warranties

The Game is provided "as is" and "as available" without warranties of any kind, express or implied. We make no guarantees about uptime, stability, or freedom from bugs.

You play at your own risk.

11. Limitation of Liability

To the fullest extent permitted by law, we shall not be liable for any indirect, incidental, or consequential damages resulting from your use of the Game or Website.

This includes loss of data, account, progress, or digital items.

12. Modifications

We reserve the right to update or revise this EULA at any time. Continued use of the Game constitutes your acceptance of the updated Agreement.

It is your responsibility to review this EULA periodically.

13. Governing Law and Jurisdiction

This Agreement shall be governed by and construed in accordance with the laws of the State of Wisconsin, United States, without regard to conflict of law principles.

Any legal actions arising from this Agreement or your use of the Game shall be brought exclusively in the state or federal courts located in Wisconsin.

14. Purchases & Digital Goods

The Game may offer optional in-game digital items through a web-based shop hosted at: forgottenlands.online/vip/. Purchases are facilitated through a secure third-party payment processor (PayPal). By making a purchase, you agree to the terms and conditions of PayPal’s checkout system in addition to this Agreement.

To complete a purchase, you must enter your in-game character name and payment information. All purchases are final and non-refundable, unless otherwise required by applicable law. Digital items purchased are delivered manually and may take up to 24 hours to appear in your in-game account.

We reserve the right to delay, withhold, or cancel digital item delivery if fraudulent activity is suspected or payment fails verification. Players are responsible for ensuring they input the correct character name during checkout. We are not responsible for items delivered to the wrong account due to user error.

15. Online Access & Service Availability

Forgotten Lands Online requires a continuous internet connection and access to our game servers to function. You acknowledge and agree that access to the Game may be interrupted or unavailable due to scheduled maintenance, technical issues, server outages, power failures, or circumstances beyond our control.

We do not guarantee continuous availability of the Game or any specific features. We may, at our sole discretion, temporarily or permanently discontinue the Game or any part of its service at any time, with or without notice.

In the event that the Game is discontinued or the servers are taken offline, your access to your account, character data, progress, and any digital items may be permanently lost. No refunds, credits, or compensation will be provided for digital items, time spent, or data loss resulting from server unavailability or Game shutdown.
